On August 5, 2015, a woman secured a settlement of $2,100,000 after she sustained a life-changing traumatic brain injury. Sadly, her injury and continuous pain left her unable to work. She was, therefore, considered totally disabled from work according to various doctors who treated, examined, and evaluated her injury and the effects of the injury. She was represented by Omar I. Habbas of Habbas & Associates and Steven R. Cavalli of Gwilliam, Ivary, Chiosso, Cavalli & Brewer APC.
The Accident
The woman worked for CBRE Property Management, where she performed numerous property inspections on a regular basis. The day of the accident, the plaintiff was inspecting a building ran by JIT Transportation. When she went to open a gate, an unbolted segment of the gate fell in her direction and struck her head. As a result, she was left dizzy and stunned. The plaintiff stated she did not remember the last portion of the inspection, despite performing the full inspection after the accident.
After driving herself home, the plaintiff began experiencing the following side effects:
- Dizziness
- Nausea
- Vomiting
- Neck pain
The Aftermath
When the plaintiff returned to work, she found that she was unable to work due to lack of concentration, lack of focus, reoccurring headaches, and serious neck pain. As a result, she was permitted to work from home for four hours every workday. Months later, the plaintiff was replaced by another employee. The plaintiff claimed that after suffering such a brain injury, she was stripped of her ability to perform important tasks in her job description. She reiterated that for 20 years before the accident, she had never suffered such problems, stating that the accident was the cause of her inability to carry out her normal work duties.
After several physicians performed examinations, evaluations, and treatments, the plaintiff was deemed unable to work. The woman has recovered the following damages:
- $67,000 in workers’ compensation
- $700,000 in future medical expenses
- $1.6 million in lost wages
